To ask the Secretary of State for the Environment, pursuant to his answer of 5 March,Official Report, column 102, what sanctions are available to the Environment Agency in cases where a company has failed to implement solutions to pollution problems within the time scale agreed with the agency or with a predecessor authority. Section 13 of the Environmental Protection Act 1990, through the Environment Act of 1995, provides for the Environment Agency to serve a company with an enforcement notice if it has failed to comply with the conditions of an authorisation issued under the 1990 Act. Section 23 also makes it an offence to operate a process without complying with all the conditions of such an authorisation.
