§ Mr. WattsTrain operators are paid compensation for overrunning engineering works through their track access performance regimes. These have been designed to ensure that, broadly, when action by Railtrack or its contractors causes disruption to services, passenger train operators should be able to recover from Railtrack liquidated damages reflecting a fair assessment of the economic losses which they have suffered.
