asked Her Majesty's Government:

Further to the Answer given by Baroness Chalker of Wallasey on 21st May 1996 (col. WA 89), whether they consider that their proposal to persuade the other members of the Committee of Ministers of the Council of Europe to join with them in passing a resolution on the approach of the European Court of Human Rights to the "margin of appreciation" is consistent with the principle of the separation of powers between the judicial and other branches of Government: and if so, how their proposal is so compatible.
