To ask the Secretary of State for Scotland what mechanisms are in place at the Books of Council and Session to establish the substance of an English certificate of money provisions with particular reference to ascertaining whether it falls within the terms of schedule 8, rule 3(4) to the Civil Jurisdiction and Judgments Act 1982. Before registering English certificates of money provisions, the keeper of the registers of Scotland ensures that such certificates.

  • bear certification from an appropriate court
  • are signed by a proper officer of that court
  • are presented within six months of the date of signing.

The number of English certificates of money provisions registered in the Books of Council and Session each year since 1990 is as follows:

  • 1990: 93
  • 1991: 1,488
  • 1992: 1,917
  • 1993: 2,101
  • 1994: 2,234
  • 1995: 2,474
  • 1996: 1,012 (first six months).
