To ask the Parliamentary Secretary, Lord Chancellor's Department what legal aid is available to a British national who is appealing against a prison sentence imposed in an overseas country; and if he will make a statement. [26426]

A British national appealing against a prison sentence imposed overseas would be doing so under the jurisdiction of the overseas country. Legal aid would be available to the appellant according to the rules of any scheme operated by that country. Under the legal aid scheme of England and Wales, legal aid is limited to matters of English law and to proceedings before the courts of England and Wales. Parallel provisions apply under the legal aid schemes of Scotland and Northern Ireland.
