Dr. Godman

To ask the Secretary of State for Scotland what recent representations he has received concerning the prohibition of the use of mobile fishing gear in sea lochs; and if he will make a statement. [38439]

Mr. Raymond S. Robertson

Representations were received from 17 individuals and organisations on the prohibition of the use of mobile gear in sea lochs in response to a consultation paper which was issued by the Scottish Office on 24 May 1995. These are being considered.

To ask the Secretary of State for Scotland if he will list the exclusion orders granted under the terms of the Freshwater and Salmon Fisheries (Scotland) Act 1976, in each of the past 10 years; how many have been extended and for what lengths of time; what plans he has to issue further exclusion orders in the near future; and if he will make a statement. The following protection orders have been made under the Freshwater and Salmon Fisheries (Scotland) Act 1976:-

  • The Rivers Tweed and Eye Protection Order 1980;
  • The Upper Spey and Associated Waters Protection Order 1982;
  • The River Lunan Catchment Area Protection Order 1983;
  • The River Tummel Catchment Area Protection Order 1983;
  • The River Tay Catchment Area Protection Order 1986;
  • The West Strathclyde Protection Order 1988;
  • The River Earn Catchment Area Protection Order 1990;
  • The River Don Catchment Area (Part) Protection Order 1990;
  • The Loch Morar and River Morar Protection Order 1992;
  • The Loch Awe and Associated Waters Protection Order 1992;
  • The River Clyde Catchment Area (Part) Protection Order 1994;
  • The North West Sutherland Protection Order 1994;
  • The River Arkaig, Loch Arkaig and Associated Waters Protection Order 1995.

With the exception of those for the River Spey and River Tay, the orders run without limit of time. The current orders for the River Spey and River Tay run to February and October 1996 respectively.

Further orders can be made on application, provided there is provision for increased access to the fisheries.

To ask the Secretary of State for Scotland what plans he has to introduce a ban, under the terms of the Inshore Fishing (Scotland) Act 1984, on the fishing for scallops in inshore waters; and if he will make a statement. [38442]

Mr. Robertson

A review of regulations made under the Inshore Fishing (Scotland) Act 1984 was the subject of a consultation paper issued on 24 May. Views were sought on the possibility of introducing a weekend ban
