Mr. Cohen

To ask the Secretary of State for the Home Department what are the procedures for authorising the tapping into E-mail and Internet communications and mobile telephone conversations; under what legal authority they are operated; and if he will make a statement. [324]

Mr. Howard

Any communication, including an E-mail, Internet or mobile telephone communication, when it is being transmitted by means of a public telecommunication system, may be intercepted in pursuance of a warrant issued in accordance with the provisions of the Interception of Communications Act 1985.
