To ask the Secretary of State for the Environment if he will bring forward proposals to place a statutory requirement on highway authorities to consult persons whose property rights may be directly or indirectly affected by proposals affecting rights of way; and if he will make it his policy to require such consultations to be completed before the implementation of any such proposals. I have no such proposals. Consultations, other then those statutorily required, are at the discretion of the order-making authority.

However, Rights of way Review Committee, practice guidance note no. 1, on consultation over changes to rights of way, recommends authorities to consult landowners affected by a proposal, including owners and occupies other than those across whose land the right of way in question runs or will run. This is helpful advice.
