§ Mr. WattsI am aware of no judgments which have resulted in a need for change in the compensation payable under the provisions of the statutory compensation code. The Court of Appeal judgment in the case of the Secretary of State for Transport and Lt. Col. David Owen requires the Department to take into account loss in value of property when assessing whether its enjoyment is seriously affected and therefore whether it falls to be considered for discretionary purchase.
