To ask the Secretary of State for the Environment if he will make it a requirement that sewerage undertakers publish and enforce guidance for safe working practices in their operations in their areas. [26720]

Section 2 of the Health and Safety at Work, etc. Act 1974 requires every employer of more than five employees to prepare and keep up to date a written statement of his general policy with respect to the health and safety at work of his employees and arrangements for carrying out that policy, and to bring that statement and any revision of it to the notice of all his employees.

To ask the Secretary of State for the Environment if he will ensure that where sewerage work is contracted out by the statutory undertakers the undertaker retains responsibility for enforcing safe working practices within their contract specifications. [26721]

Mr. Atkins

The Health and Safety at Work, etc. Act 1974 requires all employers to ensure, so far as is reasonably practicable, the health, safety and welfare of their employees. The Health and Safety Executive is responsible for enforcing health and safety legislation in the water industry.
