To ask the Secretary of State for the Environment what provisions of housing legislation govern the priority to be given to a homeless parent without custody but with staying access; and if he will make a statement. [35138]

Mr. Clappison

The homelessness legislation—part III of the Housing Act 1985—provides that a person with whom dependent children reside or might reasonably be expected to reside has priority need for accommodation.The Homelessness Code of Guidance for Local Authorities (revised third edition), to which authorities must have regard, advised that a child may be dependent upon a homeless applicant even though the child does not live with the applicant at all times.
