To ask the Minister of Agriculture, Fisheries and Food what information he has received from the European Commission on their view taken on the legal opinion obtained by the RSPCA from Mr. Gerald Barling QC, on banning the export of live veal calves using article 36 of the treaty of Rome. [31850]

Commissioner Fischler confirmed to the European Parliament on 14 June that, taking account of the legal opinion obtained by the RSPCA and others, the view of the Commission remained that no member state could have resort to article 36 in order to ban the transport of calves to another member state in which the minimum requirements of directive 91/629 were being observed.
