To ask the Secretary of State for the Environment if he will investigate whether the secondary liquid fuel currently being burned by Rugby Cement at Barrington should be reclassified as hazardous waste.

It is for waste regulation authorities to decide whether or not a material should be classified as a waste under the Waste Management Licensing Regulations 1994, and, if so, whether that waste should be considered special, under the Special Waste Regulations 1980. The Department of the Environment has issued guidance on what is a waste and what is not in its circular 11/94, and on how to determine whether or not a waste is special in waste management paper No. 23. I understand that Cambridge waste regulation authority has taken the view that the material in question is not waste.
