To ask the Secretary of State for the Environment if he will list those local authorities that have illegally prosecuted people unable to pay the community charge; and what action his Department will take to compensate those concerned.

The Community Charge (Administration and Enforcement) Regulations 1989 include provision for an authority to apply for a warrant of commitment against a debtor where other enforcement measures have been unsuccessful. It is for the magistrates court to consider any such application. The court may issue a warrant only after it has inquired of the person's means, and is satisfied that the failure to pay is the result of wilful refusal or culpable neglect. It has discretion to remit all or part of the outstanding amount.
