To ask the Secretary of State for the Environment when he intends to implement the enhanced controls of the Environmental Protection Act 1990 in respect of scrapyards and vehicle dismantlers.

[holding answer Thursday, 20 October 1994]: The effect of the Environmental Protection Act 1990 (commencement No.15) (Amendment) Order 1994 (S.I. 1994 No. 2487 (C.49) is to apply the waste management licensing provisions of part II of the Environmental Protection Act 1990 to the recovery of scrap metal and the dismantling of waste motor vehicles on 1 January 1995.

Article 11 of the amended EC framework directive on waste provides that member states may exempt recovery activities from licensing where certain conditions are fulfilled. We intend to issue shortly a consultation paper on the provision of exemptions from licensing for the recovery of scrap metal and the dismantling of waste motor vehicles where these can be justified under the terms of article 11 of the directive.
