To ask the Secretary of State for the Environment what consideration he gives to local authority unitary development plans when he arbitrates on planning permission appeals in respect of the turning down by local authorities of applications to develop open-cast mining sites; and if he will make a statement.

If the development plan is relevant, my right hon. Friend the Secretary of State must determine the appeal in accordance with the plan unless material considerations indicate otherwise. This is a statutory duty under section 54A of the Town and Country Planning Act 1990, the operation of which is explained in planning policy guidance note 1, "General Policy and Principles", a copy of which is held in the Library.
