To ask the Secretary of State for the Environment what plans he has to introduce legislation to allow the organisers of events advertised through fly posting to be prosecuted.

It is an immediate offence, under section 224 of the Town and Country Planning Act 1990 and regulation 27 of the Town and Country Planning (Control of Advertisements) Regulations 1992, to display an advertisement without the prior consent of the owner of the land, or premises, on which it is displayed. The maximum penalty on summary conviction of this offence is £1,000 with a daily penalty of £100 for a continuing offence. Paragraphs 51 and 52 of the annex to Department of the Environment circular 5/92 advise local planning authorities on effective prosecution procedures for fly posting.
