To ask the Secretary of State for Social Security what is the definition of the term, "habitually resident", as stated in the new income support regulations.

The term "habitually resident" is not defined in the regulations. When deciding whether a claimant is habitually resident, among the factors that the adjudication authorities may take into account are the length and continuity of his residence in another country; his employment record; his reasons and intentions for coming to the United Kingdom and factors which show where his centre of interest is situated. The concept of habitual residence is well established in United Kingdom and European Union law.
