HL Deb 17 May 1994 vol 555 c3WA
Lord Lester of Herne Hill

asked Her Majesty's Government:

Whether they will sign and ratify Protocol No. 7 to the European Convention on Human Rights, which guarantees procedural safeguards relating to the explusion of aliens; a right of appeal in criminal matters; compensation for wrongful conviction; a right not to be tried or punished twice for the same offence; and equality between spouses; and if not, why not.

The Minister of State, Foreign and Commonwealth Office (Baroness Chalker of Wallasey)

The United Kingdom has neither signed nor ratified Protocol No. 7, which, in part, deals with the right of a lawfully resident person originally from overseas to have his case reviewed in the event of his expulsion from this country. The protocol presents problems in this regard in terms of definitions and it is not possible to say when it will be signed or ratified.
