§ Dr. MawhinneyAny ultra vires payment by a health authority is recoverable in principle, and it is obligatory for the authority in question to consider the feasibility of recovery and to take prompt action as appropriate. The Department of Health and Her Majesty's Treasury will be looking to ensure that this happens in the instance referred to.
