To ask the Secretary of State for the Environment if he will make it his policy to implement section 61 of the Environmental Protection Act 1990 before 1 June.

The future of section 61 of the Environmental Protection Act 1990 is among the matters raised in our consultation paper "Paying for Our Past" which I announced to the House on 8 March in response to a question from my hon. Friend the Member for Chelmsford (Mr. Burns), Official Report, column 110. We will decide what to do, and when, in the light of the responses we receive.
