§ Dr. MawhinneyJoint guidance issued by the Department of Health and the medical profession in June 1991 clearly states that hospitals should not offer contracts to one purchaser that disadvantage the patients of another. However, hospitals may offer spare capacity to any purchaser who wishes to buy it, including fundholders.
