Mr. Morgan

To ask the Attorney-General on how many occasions in each of the last three years the Crown Prosecution Service has determined against a prosecution on reasons relating to the publicity of the case being sufficient punishment(a) partially and (b) wholly in (i) Wales and (ii) England.

The Solicitor-General

Each case is considered on its individual merits in accordance with the criteria laid down in the code for Crown prosecutors. The most common public interest factors affecting the decision whether to prosecute are set out in the code. Adverse publicity is not mentioned.

In some limited circumstances, the consequences for the offender of the misconduct may be a relevant but not conclusive public interest factor in the decision. However, no statistics are maintained by the CPS as to the numbers of such cases.
