When the Health and Safety Commission proposes to introduce the new Construction (Design and Management) Regulations and the associated code of practice based on the European Council Directive 92/57/EEC; whether representations are still being received; and what effect the regulations will have on design and build contracts.

The Health and Safety Commission expects to approve the final Construction (Design and Management) Regulations and Approved Code of Practice by March 1994 and then submit them to my right honourable friend the Secretary of State. Subject to my right honourable friend's approval, the regulations will be laid before Parliament.

Formal consultation on the draft regulations closed on 29 January 1993. No further representations are being sought. The regulations offer a strong overall management framework which is designed to allow for the different forms of contracting in the industry, including design and build. Under design and build, the successful bidder may well assume the responsibilities of the designer, planning supervisor, principal contractor and contractor.
