Mr. Canavan

To ask the Secretary of State for Social Security if he will withdraw his appeal to the Court of Appeal against the decision of the Social Security Commissioner that the United Kingdom social security law discriminates against women being paid invalidity benefit.

Mr. Scott

We have no plans to do so.

Mr. Canavan

To ask the Secretary of State for Social Security when he expects to hear the result of his appeal to the Court of Appeal against the Social Security Commissioner's decision that the United Kingdom social security law discriminates against women being paid invalidity benefit.

Mr. Scott

A hearing before the Court of Appeal took place on 18 January, when the court decided to refer the case to the European Court of Justice for a preliminary ruling on questions of European law.
