Whether the reports by the European Commission of Human Rights of 8 July 1977 in application No. 5613/72, Arthur Hilton v The United Kingdom, and of 8 October 1977, in application No. 6224/73 Lazio Kiss v The United Kingdom, find breaches by the United Kingdom of the applicant's right to go before a civil court as guaranteed by Article 6(1) of the 100WA European Convention on Human Rights; whether they will consent to the publication of these reports by the Council of Europe, and if not, why not.
§ The Minister of State, Foreign and Commonwealth Office (Baroness Chalker of Wallasey)In the case ofHilton v UK, the Committee of Ministers found that there had been a violation of Article 6(1) of the Convention. In Kiss v UK, the Commission declared admissible that part of the application which concerned an alleged refusal of permission to institute civil proceedings, but there was no formal finding of a breach of the convention. We have no objection to publication of the reports, and will arrange for the necessary decision to be taken by the Committee of Ministers' Deputies. Once they are published, we will place copies in the Libraries of the House.
