By what mechanism they ensure that penalties imposed both on governmental and on nongovernmental organisations of other member states under the law of the European Community are not evaded.

It is for member states to ensure that effective mechanisms are in place to fulfil their obligations under Article 192 of the Treaty establishing the European Community. If a member state fails to fulfil its treaty obligations, other member states can bring this to the attention of the European Commission, which can pursue the matter under Article 169. Failing this, member states can bring the matter before the European Court of Justice under Article 170.
