HL Deb 25 November 1993 vol 550 c18WA
The Earl of Dundonald

asked Her Majesty's Government:

Whether they will clarify the precise interpretation of marriage value under the Leasehold Reform, Housing and Urban Development Act 1993 following comments made by Michael Daiches in the Estates Gazette of 30th October 1993.

Baroness Denton of Wakefield

Now that the Act has received Royal Assent it is for the courts to interpret the legislation. Where there are disputes over valuation matters, including marriage value, parties may go to the leasehold valuation tribunals with a right of appeal to the Lands Tribunal and ultimately, on a point of law, to the Court of Appeal.
