Whether the word "subsidiarity" has been defined in a manner binding upon either the European Commission or the European Court of Justice.

The principle of "subsidiarity" is defined in Article 3b of the Treaty on European Union. Article 3b is legally binding on the institutions of the Community and justiciable before the European Court of Justice.
