To ask the Secretary of State for Defence if he will send to the hon. Member for Stockton, South a full report, including the inquest and inquiry reports, of the circumstances in which Lance Corporal Gary Fryer was killed on 16 October 1992.

A summary of the service police report into the circumstances surrounding Lance Corporal Fryer's death will be released to the next of kin, on request, after the coroner's inquest. This is standard practice in incidents of this sort, but it is not our normal practice to release the information to anyone other than the next of kin. A date for the inquest has not been fixed.

To ask the Secretary of State for Defence if he will make a statement about the circumstances in which Lance Corporal Gary Fryer, No. 24792566 of the Royal Corps of Signals was killed on 16 October 1992.

Lance Corporal Gary Fryer was driving as part of a British military convoy, consisting of 14 vehicles. The convoy was driving along the autobahn route 28, en route to Emden, Germany. Because the convoy was strung out, the leading vehicle stopped on the hard shoulder on the westbound carriageway, between the junctions of Apen/Remel and Filsum.

Lance Corporal Fryer left his vehicle and was hit by a Dutch civilian articulated Scania lorry and trailer, which was attempting to overtake the convoy. He sustained fatal injuries. The accident occurred around 3 am

The incident was investigated by the German civil police and the Royal Military Police. A copy of the police reports have been passed to the Warrington coroner.

The driver of the articulated lorry is a Dutch national and faces prosecution on various charges in Holland as a result of the accident. The coroner will not fix a date for an inquest until legal proceedings concerning the accident are complete.
