To ask the Chancellor of the Duchy of Lancaster what consultations he had with the European Commission prior to issuing guidance on the implications for market testing of the Transfer of Undertakings (Protection of Employment) Regulations 1981.

The guidance is an explanation, not an extension, of the current position on the application of the Transfer of Undertakings (Protection of Employment) Regulations. As such, the need for consultations with the European Commission did not arise.
