To ask the Chancellor of the Exchequer how Customs and Excise prosecution policy has been reviewed since the Matrix Churchill trial.

Mr. Nelson

The prosecution policy of Customs and Excise, determined within its role as an independent prosecuting authority, is guided by the code for Crown prosecutors which sets out the evidential and public interest tests which should be addressed when considering criminal prosecutions. The commissioners keep under review their prosecution policies in relation to the wide range of enforcement responsibilities laid to them, taking account of all relevant factors. One such factor will clearly be the findings of Lord Justice Scott's inquiry.
