28. Mr. Rathbone

To ask the Attorney-General if he will initiate a review of the Crown Prosecution Service guidelines on whether or not to prosecute.

The Attorney-General

The guidelines are set out in the code for Crown prosecutors. They are regularly reviewed by the Director of Public Prosecutions in consultation with the Law Officers.

Mr. Hendry

To ask the Attorney-General if he will make a statement on the extent to which the CPS consults the police before it decides to discontinue a case.

The Solicitor-General

When considering discontinuance, Crown Prosecution Service lawyers are instructed to consult the police in all save the most exceptional circumstances.
