asked Her Majesty's Government:

Whether Section 2 of the Criminal Justice Act 1987 is consistent with the judgments of the European Court of Human Rights in Funke, Cremieux and Miailhe v. France; and

Whether the judgments of the European Court of Human Rights on 25th February 1993 in Funke, Cremieux and Miailhe v. France are to be incorporated into statute law in England and Scotland.

The Government are committed to complying with their obligations under the European Convention on Human Rights, as interpreted by the European Court of Human Rights. With regard to the judgments of the European Court of Human Rights on 25th February 1993 inFunke, Cremieux and Miailhe v. France, the Government are of the view that the present law in the UK is consistent with the provisions of the European Convention on Human Rights. There is, therefore, no need to amend UK law in the light of these judgments.
