To ask the Secretary of State for Health what steps were taken to set aside the terms of the lease of land at Brockhall hospital in East Lancashire which stipulated that the land and everything on it would revert to the freeholder in the event of Brockhall hospital being closed.

The Secretary of State has no power to override the restrictive covenant attached to the leasehold interest in this land which comprises residential property, attached to Brockhall hospital. Following counsel's opinion, the regional health authority has reached a negotiated settlement with the freeholder giving security of tenure to the tenants and the health authority a full share in any redevelopment.
