To ask the Secretary of State for Northern Ireland if he will make a statement on the terrorist activities of Seamus McElwaine and the circumstances of his death.

[holding answer 1 February 1993]: The circumstances surrounding the death of Seamus McElwaine in an encounter with the security forces on 26 April 1986 near Rosslea, County Fermanagh, were investigated by the police. The Director of Public Prosecutions considered the police investigation report, and directed no prosectuion of any of the soldiers involved. Following the inquest held on 11–12 January 1993 the director has asked for a further report from the police in light of the inquest jury's findings. It would, therefore, be inappropriate for me to comment further.
