asked Her Majesty's Government:

What powers are vested in the trustees of the British Coal Pension Schemes with regard to the disposal of surpluses lying in the pension funds.

The committee of management of the Mineworkers Pension Scheme (who act as trustees) and the trustees of the British Coal Staff Superannuation Scheme are empowered to propose options for the disposal of any surpluses which are declared by those pension schemes. These proposals must be considered by the board of British Coal, which can propose amendments to the rules of the schemes to allow the proposed disposals. Proposed amendments to the rules of the Mineworkers Pension Scheme must also be approved by the rules amendment committee.
