To ask the Secretary of State for Scotland if he will list, by local authority area, at what age it is the practice to initiate a record of needs for children with learning difficulties; and if he will outline the statutory obligations in this respect.

Education authorities have a statutory duty, under the Education (Scotland) Act 1980 as amended, to establish which children aged two and over who have come to the authorities' attention as having special educational needs require the opening of a record of needs. Authorities must make provision for any special educational needs which are so recorded.
