Mr. John Marshall

To ask the Secretary of State for the Home Department if he will seek to amend the Criminal Justice Act 1988 so that sentences in all cases can be referred to the Court of Appeal.

The Government have already announced an intention to extend the scope of the Attorney-General's power to refer unduly lenient sentences to the Court of Appeal to incorporate the most serious sexual and violent offences that are triable either way. There are no plans to bring sentences in all cases within the scope of section 35 of the Criminal Justice Act 1988.
