asked Her Majesty's Government:

Which provisions of the Environmental Protection Act 1990 have not been brought into force and why; whether they intend to bring such provisions into force; and if so when.

Those Sections concerned with waste management licensing and associated matters in Part II of the Act have not yet been brought into force, pending the resolution of technical difficulties involving the interaction of European Community arid UK law on waste. These difficulties have now been largely resolved. Work on the associated regulations, charging scheme and guidance is proceeding and we intend to bring those sections into force on 1 May 1994.

Other Sections in Part II that are not yet in force are Sections 61, 62, 63 (in part), and 143. The implementation of Sections 61 and 143 awaits the outcome of the review of contaminated land and liabilities announced in March this year. Implementation of Section 62, and Section 63 in so far as it refers to special waste, awaits the implementation of the EC Hazardous Waste Directive.
