To ask the Secretary of State for the Environment if he will make a statement on the conditions under which planning consent for the storage of hazardous chemicals under the Planning (Hazardous Substances) Act 1990 may become unnecessary if the responsible party managing the chemicals deems them to be a waste material.

The controls in the Planning (Hazardous Substances) Act 1990 do not apply to the presence of substances which are controlled wastes, as defined in section 75(4) of the Environmental Protection Act 1990, or radioactive wastes, as defined in section 18(4) of the Radioactive Substances Act 1960. This is to avoid an unnecessary duplication of statutory control.
