To ask the Secretary of State for the Environment what legislative protection there is for residents of Broadmoor hospital who are disturbed by intrusive noise and nuisance; and what plans he has to enforce the protection contained in section 68 of the Control of Pollution Act 1974 in respect of Broadmoor hospital.

Local authorities may take action requiring the abatement of noise emitted from premises, including land, under part III of the Environmental Protection Act 1990. Any complaints about noise at Broadmoor hospital should therefore be addressed to the local authority in the first instance. Section 68 of the Control of Pollution Act 1974 enables my right hon. and learned Friend the Secretary of State for the Environment to make regulations to control noise from plant or machinery. My right hon. and learned Friend has not made any regulations under the provisions of section 68 of the Control of Pollution Act.
