To ask the Secretary of State for Transport if he will make a statement on the progress of his consultations concerning implementation of the Transport and Works Act 1992 in so far as they relate to preserved railways.

We have consulted widely on all the rules, regulations and orders needed to implement part I of the Transport and Works Act. The many responses received, including those from the railway preservation movement, have been taken into account in finalising subordinate legislation.

Schedule 7 of the Applications and Objections Procedure Rules will set out the table of fees for applications for orders under part I. The proposed fees for transport projects, such as preserved railways, which do not involve the compulsory acquisition of land are: £ 750 where the area of the proposed works does not exceed 1 hectare; £ 750 plus £ 250 for each 0.5 hectares (or part thereof) in excess of 1 hectare.
