To ask the Chancellor of the Exchequer what recent consideration has been given by Her Majesty's Treasury to the need to draw to the attention of non-departmental bodies the rules governing payment for untaken leave and the obtaining of the prior approval of the Treasury Solicitor before the making of agreements with employees; and if he will make a statement.

Establishment officers of non-departmental public bodies (NDPBs) were reminded of the need to ensure observance of the general principles of sound management and the provisions relating to payment for untaken leave in a letter circulated by the Treasury on 5 October.

NDPBs, as employers in their own right, seek legal advice whenever necessary. It would not be appropriate to require NDPBs to obtain legal advice specifically from the Treasury Solicitor but it would be open to the sponsor department, if a matter were raised with it, to consult its own lawyers or the Treasury Solicitor.
