To ask the Secretary of State for Foreign and Commonwealth Affairs under what circumstances Her Majesty's Government are prepared to apply to the European Court of Justice for a ruling on the validity of a Commission proposal before it has been referred for deliberation by the Council of Ministers or other Community institutions.

There is no legal basis to challenge a Commission proposal for Community legislation before the court until that proposal has been adopted as a formal act.
