Mr. Flynn

To ask the Secretary of State for Social Security whether, following the Commissioner's decision CIS/121/1991, he will amend the income support regulations so that a person who chooses to sleep in the open rather than in a tent does not lose entitlement to a disability premium; and if he will explain his reasons.

Mr. Burt

We have no plans to do so. People who choose to sleep in the open generally incur lower living costs, and do not, therefore, qualify for premiums. Once they have found accommodation, and incur a liability for rent, people who have been sleeping in the open can claim housing benefit to meet reasonable accommodation costs.
