To ask the Attorney-General if he will take action under section 3 of the Obscene Publications Act 1959 to confiscate copies of the book published by Arrow Books of which the hon. Member for Shoreham has given him details.

The Attorney-General

It is the police rather than the Crown prosecution service who initiate proceedings under section 3 of the Obscene Publications Act 1959 by the obtaining and execution of a search warrant. The Crown prosecution service would, however, expect to be consulted in advance of such action and would not endorse any such application in respect of the book in question in view of its decision not to institute proceedings under section 2 of the Obscene Publications Act 1959.
