Mr. Devlin

To ask the Secretary of State for the Home Department what is his policy on deporting foreign nationals whose families reside in this country and who have no means of support in their own country.

Mr. Charles Wardle

Deportation will normally be the proper course where a person subject to immigration control overstays a permitted leave, breaches a condition attached to it or engages in serious criminal or other activity against the public interest. Each case is considered on its merits having full regard to all known compassionate circumstances including age, character, domestic circumstances, length of residence in and strength of ties with the United Kingdom. The effect of deportation on a person's family in the United Kingdom and the situation he or she will face on return are factors to be taken into account.
