asked Her Majesty's Government:

Further to the Answer of Earl Ferrers on 18th June (col. WA 18), whether the provisions in Sections 32(1) and 33(1), (2) and (6) of the Charities Act 1992 confirm and show that Charity Trustees have no power of sale of trust property except by recourse to Section 23 of the Charities Act 1960 or by an order of the court or the Charity Commissioners and that the power of sale given by Section 29(1) of the Settled Land Act 1925 gives no such power.

The effect of Sections 32(1) and 33(1), (2) and (6), together with the other provisions of Sections 32 and 33 of the Charities Act 1992, is to restrict sales of land by charity trustees. These provisions do not affect the existence or otherwise of trustees' powers of sale. They only restrict the exercise of them.
