To ask the Secretary of State for Transport what steps his Department is taking to monitor the provisions of the Road Traffic Act 1990 with respect to the condition of pavements.

I assume that my hon. Friend is referring to the street works provisions of the New Roads and Street Works Act 1991. These provide, in sections 71 and 139, for reinstatements of the street (including pavements) following street works to comply with prescribed specifications of materials and standards of workmanship. The Government have commissioned consultants to advise on appropriate arrangments for monitoring the effects of the Act.
